Cabraal withdraws Supreme Court appeal in Greek Bond case
COLOMBO – Former Central Bank Governor Ajith Nivard Cabraal has withdrawn his Supreme Court appeal seeking to be discharged from a case over an alleged Rs 1.8 billion loss to the government arising from investments in Greek bonds.
The appeal was withdrawn with the permission of a Supreme Court bench comprising Chief Justice Preethi Padman Surasena and Justice Arjuna Obeyesekere.
President’s Counsel Thilan Rathnayake, appearing for Cabraal, informed court that an application had been filed before a three-judge High Court bench under Section 201(1) of the Code of Criminal Procedure. He sought permission to withdraw the Supreme Court appeal, which was granted.
The case alleges that investments in Greek bonds during Cabraal’s tenure as Central Bank Governor caused a loss of Rs 1.8 billion to the government. Cabraal was initially indicted before the Colombo High Court, but the indictment was subsequently withdrawn and the case refiled before a three-judge High Court bench.
In his Supreme Court appeal, Cabraal had argued that filing a second indictment under different provisions of the Prevention of Offences Relating to Public Property Act created conflicting jurisdictions and was contrary to law. He had also challenged the rejection of an objection he raised before the three-judge High Court bench.
